1. About these terms
These terms cover use of the DGL Media website and provide the baseline terms for DGL website services. A written proposal, statement of work, quotation or separately signed client agreement can contain project-specific terms. If there is a conflict, the project-specific written agreement takes priority for that project.
2. Website use
You may use this website for legitimate business and informational purposes. You must not attempt to interfere with the website, gain unauthorised access to protected areas, misuse forms or accounts, or use the site in a way that infringes another person’s rights.
3. Quotes, offers and scope
Prices shown on the website describe current starting points and promotional offers. The £349 offer is intended for a straightforward bespoke website of up to four core pages. Work outside the agreed scope, including substantial additional pages or custom functionality, may require a separate quote.
4. Client responsibilities
Clients are responsible for providing accurate business information, content, approvals and any materials they have agreed to supply. A delivery date may move where information, content, access or feedback is delayed.
5. Design and development
DGL will provide the services described in the agreed scope with reasonable care and skill. Visual mock-ups are directional until the final scope and content are agreed, and live responsive behaviour may differ appropriately from a static mock-up.
6. Fees and payment
Build fees, deposits, subscription charges and payment dates are set out in the relevant quote or checkout. Unless otherwise stated in writing, additional functionality requested after approval can be charged separately.
7. Hosting and support
Where a client uses DGL hosting, the current standard hosting and support price for the launch offer is £25 per month. Hosting remains dependent on the relevant infrastructure and third-party services continuing to be available on commercially reasonable terms.
8. Cancellation of recurring hosting
Where recurring hosting is managed through Stripe, a client may cancel through the client/billing portal where enabled. Unless a different agreement applies, cancellation is intended to take effect at the end of the paid billing period so the website is not immediately disabled when cancellation is requested.
9. After hosting ends
Once the paid hosting period ends, DGL is not required to continue providing live hosting or ongoing support unless another arrangement has been agreed. Any transfer or handover request should be made before the service end date so the practical steps and any third-party dependencies can be confirmed.
10. Intellectual property
Project-specific ownership and licence terms are confirmed in the relevant proposal or agreement. Third-party code, software, fonts, stock assets, plugins, platforms and other licensed materials remain subject to their original licences and cannot be transferred beyond what those licences permit.
11. Client content and rights
Clients must have the right to use the names, logos, copy, photographs, video, data and other materials they ask DGL to publish. The client is responsible for the legality and accuracy of those materials.
12. Portfolio use
Unless confidentiality or another written restriction has been agreed, DGL may refer to completed public work in its portfolio and marketing once the relevant project has launched.
13. Third-party services
Domains, payment processors, email providers, analytics tools, hosting platforms and other third-party services have their own terms and availability. DGL is not responsible for a third-party service changing, suspending or discontinuing its product, although we will take reasonable steps within the agreed support scope to help where appropriate.
14. Liability
Nothing in these terms excludes liability that cannot legally be excluded. Subject to that, DGL is not responsible for indirect or consequential losses, loss caused by inaccurate client-supplied information, or outages and changes caused solely by third-party systems outside DGL’s reasonable control. Any project-specific liability terms in a signed agreement take priority.
15. Suspension for security or misuse
DGL may temporarily restrict access to a client account or service where reasonably necessary to protect security, investigate misuse, comply with law or address an overdue payment, while taking the commercial context into account.
16. Changes
We may update these website terms as the service changes. The version in force when a separate client agreement is signed does not replace or alter that signed agreement unless both parties agree in writing.
17. Governing law
Unless a project agreement says otherwise, these terms are governed by the laws of England and Wales and disputes are subject to the courts of England and Wales.
